Online sabong is not available in the Philippines: e-sabong operations have been suspended nationwide since 2022, and Executive Order No. 9, signed on 28 December 2022 by President Marcos Jr., directs that the suspension continue. That is the part of the cockfighting legal picture that changed in recent years. The rest rests on a 1974 decree, and this page walks you through it so you can tell a lawful licensed cockpit from everything else.
Cockfighting legal status in the Philippines: the short answer
Philippine law treats cockfighting as a regulated tradition, not an open market. Presidential Decree No. 449, the Cockfighting Law of 1974, governs the establishment, operation, maintenance and ownership of cockpits. Anything outside that frame is unlicensed, and EO 9 itself recites that PD 449 prohibits cockfights in unlicensed cockpits.
| Activity | Status | Source |
|---|---|---|
| Cockfight in a licensed cockpit, on an allowed day | Allowed | PD 449 Section 5(d) |
| Cockfight in an unlicensed cockpit | Prohibited | EO 9 recitals on PD 449 |
| Any other gambling on cockpit premises during a fight | Prohibited | PD 449 Section 5(f) |
| Live-streaming a cockfight outside the cockpit | Suspended | EO 9 Section 1(a) |
| Online or off-cockpit betting on live cockfights | Suspended | EO 9 Section 1(b) |
What PD 449 allows inside a licensed cockpit
The decree is short, and these are its core rules in the order you meet them:
- Only Filipino citizens may own, manage and operate cockpits (Section 5(a)).
- One cockpit is allowed per city or municipality, and two where the population is over one hundred thousand (Section 5(b)).
- Cockpits go in the areas your zoning law or ordinance sets, and not near residential or commercial areas, hospitals, schools, churches or other public buildings when no such law exists (Section 5(c)).
- Cockfighting happens in licensed cockpits on Sundays, legal holidays and local fiestas for no more than three days (Section 5(d)).
- No gambling of any kind is permitted on the premises during cockfights (Section 5(f)).
The same decree defines cockfighting as the game known as the cockfighting derby, pintakasi or tupada, so the word covers more than one format. If you want the venue question in one place, read what the law says about a rooster fight and who licenses the pit.
Days when a cockpit may not hold a fight
Section 5(d) names the days when no cockfight may be held, and the list is worth knowing before you read a fiesta schedule:
- December 30 (Rizal Day)
- June 12 (Philippine Independence Day)
- November 30 (National Heroes Day)
- Holy Thursday and Good Friday
- Election or referendum day, and registration days for them
A fair, carnival or exposition may also host cockfighting for three days, on a resolution of the province, city or municipality, but not within the month of a local fiesta and not for more than two occasions a year in the same city or municipality.
Who licenses the cockpit and the people in it
Two layers of authority sit over a licensed pit. The local government grants the licence, and the Games and Amusements Board supervises the international derby end of the sport.
| Body | What it does | Where it is written |
|---|---|---|
| City or municipal mayor | Issues the cockpit licence (Section 6) | PD 449 |
| City or municipality | Licenses gaffers, referees and bet takers, renewable yearly on their birth month (Section 7) | PD 449 |
| LGUs | Authorize and license cockpits under the Local Government Code | EO 9 recitals |
| Games and Amusements Board | Permits international cockfight derbies, accredits cockpit officiating personnel | GAB mandate page |
Each official role has its own page: the gaff in cockfighting and the gaffer who arms the birds, and the bet taker, known on the floor as the kristo at a sabong.
Is online sabong legal?
No. EO 9 is titled “Directing the continued suspension of electronic sabong operations nationwide”, and its Section 1 suspends two things explicitly:
- Live-streaming or broadcasting of live cockfights outside cockpits or cockfighting arenas, or the premises where cockfights are held.
- Online, remote or off-cockpit wagering on live cockfighting matches, regardless of the location of the betting platform.
The order also directs PAGCOR to coordinate with LGUs, with the DILG and PNP rendering assistance and acting against violators. Its last paragraph of Section 1 leaves traditional cockfights authorized or licensed under existing laws outside the suspension. So the answer to “is online sabong legal” stays no for as long as this order stands, and a site that tells you otherwise has not read it.
Penalties under PD 449 Section 8
Section 8 sets two bands:
| Offender | Penalty |
|---|---|
| Financer, owner, manager or operator of a cockpit; gaffer, referee or bet taker; anyone allowing, promoting or participating in other gambling on the premises | Prision correccional in its maximum period and a fine of 2,000 pesos |
| Any other offender | Prision correccional or a fine of 600 to 2,000 pesos, or both |
The decree adds subsidiary imprisonment in case of insolvency. EO 9 also recites PD 1602, which prescribes stiffer penalties for illegal or unauthorized cockfighting activities.
The vocabulary of a licensed cockpit
Five terms carry most of the questions people search, and each has its own page:
| Term | Plain meaning | Its page |
|---|---|---|
| Rooster fight | The contest itself, and where the law lets it run | rooster fight rules |
| Dejado | The side bet taken at the longer odds | dejado and llamado explained |
| 5 cock derby | A derby format with five birds per entry | the 5 cock derby format |
| Gaff | The blade fitted to a bird’s leg | gaff cockfighting terms |
| Kristo | The bet taker who signals stakes | kristo sabong signals |
