JILIWIN Gaff Cockfighting and the Gaffer's RoleIn gaff cockfighting, the gaff is the blade fitted to a gamecock's leg and the gaffer, called taga tari in Filipino, is the person who fits it.

E-sabong operations have been suspended since 2022, and Executive Order No. 9, signed on 28 December 2022 by President Marcos Jr., continues that suspension nationwide. Nothing in that order touches a traditional rooster fight held in a licensed cockpit. To see where the line sits, start from when cockfighting is legal as a whole and then read the venue rules below, which come straight from the decree.

What the law allows at a rooster fight

PD 449, the Cockfighting Law of 1974, governs the establishment, operation, maintenance and ownership of cockpits. It lets a rooster fight take place under a short list of conditions, and each one has a section number you can look up.

ConditionWhat PD 449 saysSection
VenueLicensed cockpits only5(d)
DaysSundays and legal holidays5(d)
FiestaLocal fiestas, not more than three days5(d)
Fairs and expositionsThree days, on a local resolution, not within the fiesta month5(d)
Number of pitsOne per city or municipality, two above one hundred thousand people5(b)
OwnershipFilipino citizens only5(a)

The decree’s own term for the contest is “cockfighting derby, pintakasi or tupada” in Section 4(a), so the same law covers the fiesta pit and the multi-bird derby. The cock derby format has its own page.

Who licenses the venue for a rooster fight

The cockpit licence comes from local government, with a national check built in. Follow the order the decree gives:

  1. A cockpit owner applies to the city or municipal mayor, who is authorized to issue licences under Section 6.
  2. The decree makes that licence subject to the approval of the Chief of Constabulary or his authorized representative.
  3. The city or municipality may set taxes and fees by ordinance, within the rates the decree refers to.
  4. EO 9 adds that the Local Government Code, in Sections 447(3)(v) and 458(3)(v), has LGUs authorize and license the establishment, operation and maintenance of cockpits and regulate cockfighting.

The people who run the fight need licences too. Gaffers, referees and bet takers may not act without a licence from the city or municipality, renewable every year on their birth month, and the gaff in cockfighting page covers the gaffer’s part.

Where a rooster fight may not be held

Section 5(c) keeps the pit away from daily life. Where no zoning law or ordinance exists, local executives must see that no cockpit is built within or near existing residential or commercial areas, hospitals, school buildings, churches or other public buildings. Building permits go through the city or provincial engineer.

Section 5(d) closes the calendar on these days:

  1. December 30 (Rizal Day)
  2. June 12 (Philippine Independence Day)
  3. November 30 (National Heroes Day)
  4. Holy Thursday and Good Friday
  5. Election or referendum day and the registration days for it

What stays banned around a rooster fight

Three prohibitions matter most for anyone reading about the sport:

  1. Section 5(f) says no gambling of any kind is permitted on the premises during cockfights, and the owner, manager or lessee is criminally liable with the violator.
  2. Section 8 sets the penalty: prision correccional in its maximum period and a fine of 2,000 pesos for a financer, owner, manager, operator, gaffer, referee or bet taker.
  3. EO 9 Section 1 suspends live-streaming of cockfights outside the cockpit and online or off-cockpit betting on live events.

A rooster fight you watch on a phone, away from the pit, falls inside that suspension. A fight you attend in a licensed pit does not.

Words you will hear at the pit

Fans use a small vocabulary at a rooster fight:

WordMeaning
LlamadoThe bird the crowd expects to win
DejadoThe other side, the underdog; see the dejado and llamado sides
SentenciadorThe referee, defined in PD 449 Section 4(e) as the person who oversees the gaffing, judges the cocks’ condition and announces the winner, a tie or no contest

If a question about a fight needs a legal answer, ask the city or municipal hall that licenses the pit, and read PD 449 and EO 9 at lawphil.net. You must be 21 or older to play any game of chance.
